These terms cover buying tokens and getting leads from BuyFEXLeads, a sole proprietorship owned and run by Nick Georgalos (“we”, “us”). By creating an account, buying tokens or using the service, you agree to them. The short version: all sales are final except under the Delivery Guarantee in our Refund Policy, bad leads get token credit, and you contact us before disputing a charge.

1. Who can buy

BuyFEXLeads is for licensed insurance professionals buying leads for their business. You are buying as a business, not as a consumer, and not for personal, family or household use.

You confirm you hold an active life insurance license in every state you pick, and you’ll remove a state if that license lapses. The National Producer Number on your account must be yours. You must be at least 18.

If any of this isn’t true, we may close your account without a refund. That includes any tokens left on it.

2. Tokens and leads

Tokens are prepaid credits you use to buy leads and, if you choose, live calls. You buy them in packs from your dashboard. Each lead uses 5 tokens.

Tokens have no cash value. They can’t be sold, transferred or moved to another account. They are not a deposit, a gift card, or a stored-value account, and they earn no interest.

A lead is a person who completed our final expense quiz in a state you picked.

3. Each lead is yours for 30 days

Every lead goes to one agent. No other agent receives that lead for 30 days after it’s delivered to you. After 30 days, we may sell it to other agents as an aged lead.

4. How the service is delivered

What you buy is tokens, a digital service. It is delivered when the tokens are added to your account, which happens as soon as your payment goes through.

Leads then arrive over time, at our pace. When a lead finishes our quiz, we assign it to an agent in that state who has an open lead order covering that state, enough tokens, and is under our pacing limits, and send it by text and email as soon as it’s assigned. It also shows in your dashboard. We send up to 25 leads per agent in any 7 days and no more than 5 in any 24 hours.

How many leads you get, and how fast, depends on your states and our ad volume. We don’t promise a minimum number of leads, a delivery date, or a delivery speed. While your account is paused you get no leads and use no tokens. Tokens keep their expiry date while you’re paused.

5. No guarantee of results

We don’t guarantee that you’ll reach a lead, set an appointment or make a sale, from a lead or a live call. We don’t promise any contact rate, close rate, income or return on what you spend.

Some people won’t answer, will change their minds, can’t afford a policy, or already have coverage. That is part of working leads. It doesn’t make a lead defective. The only defects are the ones in our Refund Policy.

6. Where leads come from, and your calling rules

Leads come from our Meta ads (Facebook and Instagram), which send people to our final expense quiz. Before submitting, each person verifies their phone number with a text code and agrees to be contacted by licensed insurance agents about final expense insurance. We sell only leads that completed that step.

You are responsible for how you contact every lead. That includes the TCPA, the National Do Not Call Registry, state do-not-call lists, state telemarketing and insurance rules, and your carriers’ rules. Only contact leads in states where you’re licensed. If a person asks you to stop contacting them, stop.

You may not resell, share or give away leads we send you.

7. First order offer

Your first paid order gets free bonus tokens on top of what you pay for: 3 free leads (15 tokens) on an order of 25 or more leads, 10 free leads (50 tokens) on an order of 50 or more leads, 15 free leads (75 tokens) on an order of 100 or more leads. The bigger bonus replaces the smaller one; they don’t add up. The price you pay doesn’t change.

It’s once per agent. It only applies if you have no earlier paid order, and it’s tied to your verified phone number and your card: if another account with the same phone or card has already bought, there’s no bonus. We check this when your payment goes through, so a bonus shown on the page may not apply. Bonus tokens expire with that order, 12 months after purchase, and have no cash value.

First-order guarantee: if a bad lead is among the leads delivered from your first order (the number of leads paid for plus the bonus, counted in the order they arrive), and we approve the report, we credit the whole lead back (5 tokens) instead of 3 tokens. The usual report rules still apply.

8. Tokens expire after 12 months

Tokens expire 12 months after purchase. Leads use the tokens that expire soonest first. Expired tokens are removed and not refunded.

9. All sales are final, except the Delivery Guarantee

Token purchases are final and non-refundable, except under the Delivery Guarantee in the Refund Policy. Apart from that guarantee, we don’t refund cash for any tokens: unused, spent, expired, or forfeited. We also don’t refund tokens when you close your account or we close it. Delivered leads are never refunded.

The Delivery Guarantee: if we deliver fewer than 10 leads in the 30 days after a purchase, you can ask for a refund of that purchase’s unused paid tokens, on the conditions in the Refund Policy. Only days your account is live count toward the 30, and a day is live only with an open lead order for one of your states.

The only remedy for a bad lead is the token credit in our Refund Policy. We may choose to give extra credits in a case we think is fair. That is our choice each time. It doesn’t change these terms or give you a right to the same thing again.

10. Orders

Your tokens are used through orders. On your dashboard you order a number of leads or live calls for the states you pick. An order holds no tokens: they are used only as it fills, 5 tokens for each lead and 10 tokens for each billed call. An order can’t be bigger than the tokens you have that aren’t already on your other orders.

You can pause, change or cancel an order at any time. Cancelling uses no tokens, and the tokens it would have used stay in your balance. Without an open order you get no leads or calls. If your tokens run out or expire, an order stops filling until you add more. An order doesn’t change when tokens expire, and it isn’t a promise of how many leads or calls we deliver or how fast.

11. Live calls: how they work

Live calls are optional and off until you place a call order on your dashboard. While you have an open call order with calls left and at least 10 tokens, a person who calls our number from a state the order covers may ring your verified phone. We ring one agent at a time, and we decide the order.

Calls use tokens from the same balance as your leads. They keep the same expiry date, have no cash value, and are covered by the same rules: all sales are final, except under the Delivery Guarantee. A billed call counts toward your call order.

12. Live calls: what they cost

Before the call connects you hear the caller’s state and the price. Pressing 1 is your acceptance of the charge. A call you take uses 10 tokens if it lasts 90 seconds or more, counted from when you press 1. Shorter calls are free. If your balance runs out during a call, we take what’s left and no more.

Missed calls. If a call rings you and you don’t press 1 (you don’t answer, your line is busy, you decline it, or you answer without pressing 1), it is a missed call. Your first 2 missed calls in a row are free. The 3rd missed call in a row costs 10 tokens, taken from your token balance (never more than what’s there), and pauses your live calls. A caller hanging up while your phone rings, or a failure on our side or our carrier’s, is not a missed call. Taking a call, or having calls turned back on, starts the count over. The missed call fee is final and never earns a bad call credit.

Paused calls stay paused until we approve your request to turn them back on. You send it from your dashboard. We decide at our discretion, and you can ask again 24 hours after a denial. Your leads are not affected while calls are paused.

Our call records, which come from our phone carrier, decide whether you pressed 1, how long the call lasted and how it ended. They are final.

A billed call shows in your dashboard as a lead with our recording, counts toward the pacing limits above, and goes to your CRM connection like any lead. The only remedy for a bad call is the bad call credit in our Refund Policy: 6 tokens, in tokens, on the closed list of reasons there.

13. Live calls: what we don’t promise

We don’t promise any number of calls, any timing, or any mix of states.

We estimate the caller’s state from the area code of their phone number. People keep their numbers when they move, so the estimate can be wrong.

Callers are not quiz leads. They called us, so they have not verified their phone number with a text code and there is no consent certificate for them. We don’t promise that a caller qualifies for a policy, will buy, or is who they say they are.

Calls are not exclusive. A caller may call our number again and reach another agent, and a billed call is still billed.

Calls depend on our phone carrier and our systems. Calls may be dropped, delayed or unavailable because of outages, and we give no credit for that.

14. Live calls: your duties

  • Be licensed in the caller’s state before you quote or sell them anything.
  • Follow every law that applies to what you do on the call and after it, including any follow-up calls or texts. That includes insurance laws, the TCPA, the National Do Not Call Registry, state do-not-call and telemarketing laws (including state “mini-TCPA” laws), and call-recording laws.
  • Don’t make false or misleading statements to a caller.
  • Don’t record the call yourself unless the caller agrees to your recording.
  • Use what you learn about a caller only to serve that caller. Never resell, share or give it away.

15. Live calls: recording

We record every call you take. The caller hears a notice that the call may be recorded before they reach you. By taking live calls, you agree to be recorded. We may use recordings for quality, to settle disputes and chargebacks, to decide bad call credits, and for compliance, and we may listen to any of them.

16. Live calls: our rights

We may pause or turn off live calls for any agent at any time, for example for repeated missed calls, caller complaints, abuse or suspected fraud. Calls we pause come back only when we approve a request to turn them back on. We may change the price of a call or the rules for billing it. A change applies only to calls after we post it and tell you by email or in your dashboard; it never changes the price of a call already taken.

17. Bad leads get token credit

If a lead is bad, as defined in our Refund Policy, report it from your dashboard within 7 days of delivery and attach the call recording. If we approve it, we credit 3 tokens to your account (5 tokens under the first-order guarantee). A live call has its own bad call credit, set out in the Refund Policy. Credits are tokens, never cash. Our decision is final.

18. Chargebacks and payment disputes

If something looks wrong with a charge, email hello@buyfexleads.com first. You agree to use the bad-lead credit process, and to contact us and give us a chance to fix it, before you open a chargeback or payment dispute with your bank or card company.

If you open a chargeback or payment dispute on a purchase covered by these terms:

  • Your account is put on hold right away. Lead delivery stops, and you can’t buy tokens or file reports while it’s on hold.
  • We may close your account and cancel any tokens left on it. Cancelled tokens are not refunded.
  • We may contest the dispute. To do that we send the card company our records: your acceptance of these terms at checkout, your sign-ins, and every lead delivered to you.
  • Where the law allows, you are responsible for what you owe us, plus the chargeback fees we’re charged and reasonable costs of collecting.
  • If the dispute is withdrawn or decided against you, you are not owed a refund.

19. Suspension and closing accounts

We may suspend or close an account for a chargeback, for abuse such as reselling leads or caller information, false or excessive bad-lead or bad-call reports, or contacting leads or callers in ways that break the rules above, or if what you told us about your license isn’t true. A suspended account gets no leads. Tokens on a closed account are forfeited and not refunded. You can pause delivery or stop using the service at any time.

20. No warranties

The service and the leads are provided “as is” and “as available”. Apart from what these terms and our Refund Policy say, we make no promises about the leads or the service, express or implied. That includes any promise that a lead is accurate, will answer, will buy, or fits a particular purpose, and any promise that the site will always be up or free of errors.

21. Limit on our liability

Our total liability to you for any claim about the service or these terms, including live calls, is limited to what you paid us in the 3 months before the claim arose.

We are not liable for lost profits, lost commissions, lost business, or any indirect, incidental, special or consequential damages, even if we were told they were possible. Some states don’t allow some of these limits, so they apply as far as the law allows.

22. Your responsibility for how you use leads and calls

You agree to defend and cover us (and pay our reasonable costs, including lawyers’ fees) for any claim, fine or loss that comes from how you contact or use the leads we send you, from what you do on or after a live call, or from breaking these terms. That includes claims about licensing, sales practices, the TCPA, do-not-call rules, state telemarketing laws, call-recording laws and insurance rules.

23. Disputes and governing law

California law governs these terms, without regard to its conflict-of-law rules. Any court case must be brought in the state or federal courts for Monterey County, California, and you agree to those courts.

Before you file any claim, email hello@buyfexleads.com with what’s wrong and what you want. We then both have 30 days to try to settle it in good faith. You may not file a claim until those 30 days have passed.

Claims may only be brought by you individually, not as a plaintiff or class member in a class, collective or representative action. Either of us may still bring a claim in small claims court if it qualifies there.

24. Changes to these terms

We may change these terms. When we do, we post the new version here with a new date. If you have already bought, we’ll ask you to accept the new version in your dashboard before your next purchase.

Each purchase is covered by the version shown and accepted at checkout, where you tick a box that reads: “I agree to the Terms and Refund Policy. Delivered leads are non-refundable. Unused tokens are refundable only under the Delivery Guarantee.”. Using the service after a change means you accept the new version.

25. The rest

If part of these terms can’t be enforced, the rest still applies. If we don’t enforce a term right away, we can still enforce it later. These terms, our Refund Policy and our Privacy Policy are the whole agreement between us about the service.
